Late Hours Catering
If you intend to sell hot food or hot drink
between the hours of 11pm and 5am from permanent or temporary
premises (including burger vans and stalls) then a
licence under the Licensing Act 2003 is now required. This
includes vans, mobile stalls and premises. You must also be
registered as a food business with Environmental Health.
The supply of hot drink by vending machine to
which the public have access and is operated by members of the
public without staff involvement, with payment being inserted into
the machine is not licensable. This exemption however does not
apply to hot food.
The supply of hot food or hot drink free of
charge is exempt provided that there is no charge for entry to
the premises nor for some other item in order to obtain the hot
food or hot drink.
