Validation Requirements

New Local List Requirments for applications submitted to Melton Borough Council were adopted on 28 July 2011. They can all be found on the local list requirements page, split into the individual application types.

 

National Requirements

 

The Government amended the Town and Country (General Development Procedure) Order 1995 (the GDPO) to introduce a mandatory standard application form (1APP) on 6 April 2008.

 

Along with the application forms new information requirements for the validation of planning applications by local planning authorities was also introduced. A ‘National list’ has been compiled which contains a list of statutory information required to accompany all applications as specified in the GDPO.

 

The purpose of the new validation arrangements, is to:

  • provide a guide to the information that may be required at the outset;
  • enable the local planning authority to provide applicants with certainty as to the information required;
  • enable the local planning authority to have all the necessary information to determine the application and to draft the planning permission and all conditions;
  • minimise the need for further submission of additional information in order to allow local planning authorities a reasonable opportunity to determine applications to meet  performance targets
  • ensure consistency in the approach taken by different local planning authorities in registering and validating applications whilst recognizing the need for variation appropriate to local circumstances.

 

Melton Borough Council are now validating applications in accordance with the ‘National list’ and therefore the following is a list of the statutory information which must be submitted for an application to be considered valid:-

  • Completed form (3 copies to be supplied unless the application is submitted electronically)
  • A plan which identifies the land to which the application relates drawn to an identified scale and showing the direction of North (3 copies to be supplied unless the application is submitted electronically)
  • A copy of other plans and drawings or information necessary to describe the subject of the application (3 copies to be supplied unless the application is submitted electronically) including:

– Block plan of the site (e.g. at a scale of 1:100 or 1:200) showing any site boundaries

– Existing and proposed elevations (e.g. at a scale of 1:50 or 1:100)

– Existing and proposed floor plans (e.g. at a scale of 1:50 or 1:100)

– Existing and proposed site sections and finished floor and site levels (e.g. at a scale of 1:50 or 1:100)

– Roof plans (e.g. at a scale of 1:50 or 1:100)

  • The completed Ownership Certificate (A, B, C or D – as applicable) as required by Article 7 of the Town and Country Planning (General Development Procedure) Order 1995
  • Agricultural Holdings Certificate as required by Article 7 of the Town and Country Planning (General Development Procedure) Order 1995
  • Design and Access Statement, if required
  • The appropriate fee
  • In addition, where Ownership Certificates B, C or D have been completed, notice(s) as required by Article 6 of the Town and Country Planning (General Development Procedure) Order 1995 must be given and/or published in accordance with this Article

 

Local List

 

The local list comprises additional information which local planning authorities can require to validate an application. The combined use of the national and local list afford both the authority and applicant more certainty on the type of information required at the outset and also help to ensure that the information requested is proportionate to the type and scale of application being made.

 

Following a period of consultation in partnership with other Leicestershire Authorities, Melton Borough Council adopted revised local list validation requirements on 28th July 2011 and therefore any application received after this date will be subject to these requirements. The list will be reviewed every three years (as recommended by the Government) and any minor amendments to take account of statutory changes or Government Guidance will be made as and when necessary.
