Commercial Waste
Commercial or Trade waste cannot be collected as part of Melton
Borough Council's domestic waste service. However, we can arrange
for the collection of commercial / trade waste using an external
waste management company, the cost of which includes an arrangement
fee.
Customers may wish to note that they can deal directly with a
private waste management company and avoid additional charges from
the Council.

Definition of Commercial Waste
Under Section 12(1) of the Control of Pollution Act 1974
commercial waste consists of waste from premises used wholly or
mainly for the purposes of a trade or business or for the purposes
of sport, recreation or entertainment. Waste of the following
descriptions is excluded from the definition:- household waste and
industrial waste; waste from any mine or quarry within the meaning
of section 180 the Mines and Quarries Act 1954; waste from premises
used for agriculture within the meaning of section 109(3) of the
Agriculture Act 1947. Description of waste which is to be treated
as commercial waste are:- waste from an office or showroom; waste
from premises providing facilities for passengers at an airport,
hoverport, seaport, railway station or bus station; waste from a
mixed hereditament is defined as one which is not a domestic
hereditament but in the case of which the proportion of the
rateable value attributable to the part of the hereditament used
for the purposes of a private dwelling is greater than one eighth
(eg a shop with living accommodation). At present, some authorities
recognise the domestic element of waste from mixed hereditaments by
collecting one free bin a week and charging for the balance as
trade refuse. In setting the level of their charges for commercial
waste authorities may consider that it is reasonable to recognise
that some of the waste from a mixed hereditament arises from what
would otherwise be a private dwelling; waste from premises occupied
by a club, society, or any association of persons (whether
incorporated or not) in which activities are conducted for the
benefit of the members; waste from premises (not being premises
from which waste is by virtue of the Act or of any other provision
of the Regulations to be treated as household waste or industrial
waste) occupied by:- a court; a government department;. a local
authority; a body corporate or an individual appointed by or under
any enactment to discharge any public functions, other than a body
corporate established by or under any enactment for the purpose of
carrying on under national ownership any industry or part of an
industry or any undertaking; or a body incorporated by a Royal
Charter; waste from a tent pitched on land other than a camp site;
and waste from a market or fair.
