Discharge of planning conditions

Guidance, forms and fees

The Government has introduced new fees for the discharge of planning conditions from 6 April 2008.

A fee is now payable where a written request is made for the discharge of one or more conditions on the same permission or for the written confirmation of compliance with a condition or conditions. The fee is payable per written request to discharge conditions not per condition and therefore any number of conditions may be included on a single request.

The fees are as follows:-

1. Conditions attached to Listed Building

2. Conservation Area Consents.

Free of Charge

3. Householder extensions, alterations and    changes to buildings within the curtilage of a dwelling, construction of fences, walls, car parking and hard standing.


4. Any other type of development


The fee must be paid when the request is made, and cannot be received retrospectively. It does not matter when the permission was granted.

If a condition is not approved or discharged on an application then there is no charge for resubmission providing it is within 12 months of the original decision being issued. However, if you wish to revise details already approved an additional charge will be payable.
